Case Name: Lamar Daily News v. Warn

Description: Gary Warn has been rallying opposition to plans to locate a private prison in his community, Lamar, Colorado. He has spoken out at public meetings, written letters to the editor, and gathered signatures in an effort to put the issue on the ballot for a vote of the local electorate. In late July, 2004, the Lamar Daily News filed a civil action for a restraining order against Mr. Warn. The County Court issued an ex parte temporary restraining order forbidding Mr. Warn from having any contact with the newspaper or two of its reporters. The order forbids Mr. Warn from writing letters to the editor.
At a hearing scheduled for August 13 on whether to make the order permanent, the ACLU defended Mr. Warn and persuaded the Court to lift the restraining order.
