This case, which names the Weld County sheriff and district attorney as defendants, challenges the validity of the search warrant and the subsequent search of tax records and asserts that Weld County officials violated the right of privacy of thousands of innocent taxpayers who were not suspected of any wrongdoing.

The Manager of Safety refused to produce the manual under Colorado open records laws based on the ground that disclosure would be “contrary to the public interest.”

This lawsuit, filed under Colorado’s open records laws, seeks an order that Denver disclose records related to budgeting for and purchase of police equipment such as “less lethal” weapons dating back to January 2007, when Denver was selected as the host city for the 2008 Democratic National Convention.

The ACLU filed this lawsuit on behalf of Mercedes Archuleta, who was falsely arrested, strip-searched, and jailed on the basis of a groundless and wrongfully obtained arrest warrant that accused her of a Lakewood ordinance violation with which she had no connection whatsoever.
