ACLU Stands Up for Fourth Amendment Rights of Loveland Gun-Owner

Mr. Bill Miller was sitting on a park bench in the early evening, when Loveland Police Department officers approached him, seized his handgun without consent, and demanded he produce identification. Mr. Miller's handgun, unconcealed and holstered on his waistband, was legal — but the unreasonable search and seizure performed by the police officers was not. Without reasonable fear for the safety of an officer, which was absent in this situation, the search, detention, and investigation of an individual legally possessing a firearm is prohibited by the Constitution.
